Critical: Biometric Data Collection

Creating AI avatars involves processing biometric information, including facial geometry (extracted from photos/videos you upload) and voice characteristics (voiceprints from audio recordings). This data is considered biometric identifiers under laws like BIPA (Illinois), CUBI (Texas), and similar state laws. For complete details, please read our Biometric Data Privacy Policy.

For AI avatar creation, we collect:

Photos/images you upload
Voice samples and audio recordings
Avatar configurations and preferences
Generated avatar content

Hedra and Biometric Data

When you create AI avatars, your photos and voice recordings (including biometric identifiers) are sent to Hedra for processing. Hedra's use of your data is governed by their privacy policy.

4.3 Your Authorized Integrations

We share data with platforms you explicitly connect to Swayed (e.g., Slack, Shopify, Google Drive). You control what data is shared through these integrations.

4.4 Legal Requirements

We may disclose your information if required by law or to:

Comply with legal obligations or valid legal requests
Protect the rights, property, or safety of Swayed, our users, or others
Detect, prevent, or address fraud or security issues
Enforce our Terms of Service or other policies

5. Data Retention

We keep your account data while you're an active user
Canvas content is retained until you delete it
Biometric data is deleted within 30 days of avatar creation completion or account closure (whichever comes first)
After account closure, we retain minimal data for legal compliance (typically 30-90 days)
Backups may retain data for up to 90 days after deletion

You can delete your data at any time. Go to your account settings to delete specific content, avatars, or your entire account. Biometric data will be permanently deleted within 30 days.

8.3 Your AI Avatars

You can export and use your AI avatars outside of Swayed
You control who sees and uses your avatars
We don't use your avatars for our own purposes
You can delete avatars and associated biometric data at any time

9. Data Storage and Security

Your data is stored on secure servers within the United States
We use encryption for data in transit (TLS/SSL) and at rest (AES-256)
We implement industry-standard security measures, including firewalls and access controls
