This Acceptable Use Policy ("AUP") outlines prohibited uses of Swayed. By using our platform, you agree to comply with this policy. Violations may result in account suspension or termination.

This Acceptable Use Policy is part of our Terms of Service. Violations of this policy constitute a breach of the Terms and may result in immediate account termination.

1. Prohibited Content

You may not upload, create, or share content that:

1.1 Illegal or Harmful Content

Violates any local, state, federal, or international law
Promotes or depicts illegal activities
Contains malware, viruses, or malicious code
Facilitates fraud, scams, or deceptive practices
Promotes violence, terrorism, or harm to others

1.2 Inappropriate or Offensive Content

Adult or sexual content (NSFW, pornography, sexually explicit material)
Graphic violence, gore, or disturbing imagery
Hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
Content promoting self-harm, suicide, or eating disorders
Bullying, threatening, or harassing behavior

1.3 Content Involving Minors

Zero Tolerance for Minors

STRICTLY PROHIBITED: Any content featuring individuals under 18 years old, uploading photos, videos, or voice recordings of minors, creating avatars based on minors' likenesses, processing biometric data of anyone under 18. Violations will result in immediate account termination and reporting to authorities.

Copyrighted material you don't have rights to use
Trademark violations or brand impersonation
Unauthorized use of proprietary information
Plagiarized content

2. Biometric Data and Avatar Restrictions

2.1 Consent Requirements

Biometric Consent is Mandatory

You MUST have explicit written consent before uploading: Photos or videos containing another person's face, voice recordings of other individuals, any biometric data that is not your own. Consent must be documented and available upon request.

2.2 Prohibited Avatar Uses

You may not use AI avatars or video features to:

Create deepfakes for deception: Impersonate real people without their consent
Fraud or scams: Use avatars to deceive others for financial gain
Identity theft: Impersonate someone to access accounts or services
Defamation: Create false or damaging content attributed to others
Bypass identity verification: Use avatars to circumvent KYC/AML checks
Political manipulation: Create misleading political content
Non-consensual pornography: Create sexual content using others' likenesses

2.3 Celebrities and Public Figures

Creating avatars of celebrities, politicians, or public figures without permission is prohibited, even if you disclose the content is AI-generated. Exceptions: Parody or satire may be permitted if clearly labeled and not used for commercial purposes. Contact support@swayed.io for guidance.

3. Prohibited Activities

3.1 Abuse and Exploitation

Spam: Sending unsolicited messages or promotional content
Harassment: Targeting individuals with abusive behavior
Phishing: Attempting to steal credentials or personal information
Social engineering: Manipulating others to divulge sensitive information
Doxxing: Sharing private information without consent

3.2 System Abuse and Security Violations

Hacking: Attempting to gain unauthorized access to Swayed or user accounts
Reverse engineering: Decompiling or extracting Swayed's code or AI models
Scraping: Automated data extraction without permission
DDoS attacks: Overwhelming our servers with traffic
Exploiting vulnerabilities: Using bugs or security flaws to gain advantages
Bot automation: Using automated scripts to abuse features

3.3 Unauthorized Commercial Use

Reselling access to Swayed without authorization
Creating a competing service using Swayed's technology
Using Swayed for pyramid schemes or MLM scams
Misrepresenting your relationship with Swayed

4. Legal and Regulatory Compliance

4.1 Biometric Privacy Laws

You are responsible for complying with all applicable biometric privacy laws, including but not limited to:

Illinois BIPA: Biometric Information Privacy Act (740 ILCS 14/)
Texas CUBI: Capture or Use of Biometric Identifier Act (Tex. Bus. & Com. Code § 503.001)
Washington HB 1493: Biometric privacy requirements
California CCPA/CPRA: Biometric information protections
Other state and international biometric privacy regulations

User Liability

You are solely liable for violations of biometric privacy laws. Swayed is not responsible for your misuse of biometric data. Statutory damages can range from $1,000 to $25,000 per violation.

4.2 Data Protection and Privacy Laws

GDPR (if you have users in the EU)
State privacy laws (CA, VA, CO, etc.)
Industry-specific regulations (HIPAA, FERPA, etc.)
International data transfer restrictions

4.3 Export Controls and Sanctions

Do not use Swayed in countries subject to U.S. sanctions
Comply with export control regulations
Do not provide access to prohibited parties

5. Enforcement and Reporting

5.1 Monitoring and Detection

Swayed reserves the right to:

Monitor content for policy violations (manual and automated)
Review flagged accounts and content
Investigate reported violations
Cooperate with law enforcement

We don't actively monitor all content, but we do review content flagged by automated systems or user reports.

5.2 Consequences of Violations

Depending on the severity and frequency of violations, we may:

Warning: First-time minor violations may receive a warning
Content removal: Delete violating content
Feature restrictions: Limit access to specific features (e.g., avatar creation)
Temporary suspension: Suspend account for 7-30 days
Permanent termination: Close account and ban from Swayed
Legal action: Pursue civil or criminal charges for serious violations
Report to authorities: Report illegal content to law enforcement

5.3 Immediate Termination Offenses

The following violations will result in immediate account termination without warning:

Any content involving minors, non-consensual use of biometric data, deepfakes for fraud or deception, child sexual abuse material (CSAM), terrorism or violence promotion, hacking or security attacks, repeated violations after warnings.

5.4 Reporting Violations

If you see content or behavior that violates this policy:

Include: Description, screenshots, user account (if known), date/time
Response time: We investigate all reports within 48 hours

We do not retaliate against good-faith reports. Your identity will be kept confidential.

6. Special Provisions

6.1 AI-Generated Content Disclosure

When sharing AI-generated content outside Swayed, you should:

Clearly label content as AI-generated where required by law or platform policies
Not misrepresent AI content as authentic human content
Comply with platform rules (YouTube, TikTok, etc.) regarding synthetic media

6.2 Age Verification

You affirm you are 18 years or older
Misrepresenting your age is grounds for immediate termination
We may request age verification documents for suspicious accounts

6.3 Third-Party Content and Integrations

You're responsible for compliance with third-party terms (YouTube, TikTok, etc.)
Don't scrape content from platforms that prohibit it
Respect robots.txt and website terms of service

7. Changes to This Policy

We may update this Acceptable Use Policy to reflect new features, legal requirements, or community standards. We'll notify you of significant changes via email or in-app notice.

Continued use after changes constitutes acceptance
Material changes effective 30 days after notice

What's NOT allowed: Any content involving minors, using others' biometric data without consent, creating deceptive deepfakes, illegal, harmful, or NSFW content, harassment, hate speech, or bullying, hacking, spamming, or abusing the system.

What IS allowed: Creating avatars of yourself, using avatars with proper consent, business and creative content, marketing, education, and entertainment, labeling AI content appropriately.
